Federal law only guarantees unpaid

While New Jersey\'s family leave provisions are similar to the federal Family Medical Leave Act, the state allows employees to take paid leave to care for a newborn or sick family member. Federal law only guarantees unpaid leave for this purpose.

In New Jersey, the Paid Family Leave Act allows eligible employees to take up to six weeks per year of paid leave to care for a newborn, a newly adopted child or a sick qualified family member - a spouse, child, parent, domestic partner or partner in a civil union. Those who take advantage of this paid leave are paid two-thirds of their weekly salary, with a cap of $524 per week. Paid leave is not available for their own serious medical conditions.

While on leave, the New Jersey Family Leave Act prevents employees from performing full-time work for another employer, but they are allowed to work on a part-time basis for a non-leave-granting employer.

New Jersey law also allows employees to combine their state and federal C2c jerseys leave entitlements to maximize their leave. Under the federal Family Medical Leave Act, the employee can take up to 12 weeks of unpaid leave for their own serious medical conditions, the birth or adoption of a child or the serious illness of a qualified family member. Therefore, if an employee gives birth to or adopts a child, she may take six weeks of paid leave to care for the newborn as well as another 12 weeks of unpaid leave granted to her by the FMLA.

Other Variations From the Federal FMLA laws

New Jersey employees returning from authorized family leave must be reinstated to the same or similar position, with 2 exceptions. If a person is considered a key employee, they may or may not be reinstated. If a company layoff for which the employee\'s position is eligible occurs while he or she is on leave, they also may not be reinstated.

Sometimes leave time can be longer than necessary, or place a financial burden on the family. However, the employer does not have to allow the employee to return from leave early if it would cause a problem for the company.

The employer does have the right to refuse family leave to highly paid employees - the 5 percent of highest-paid salaried employees - if the leave will cause \"substantial and grievous economic injury\" to operations. Federal FMLA laws do not offer such a stipulation.

Lastly, New Jersey public employees have the option to use a voluntary furlough of up to 30 days for family leave purposes. Furloughs cannot be applied to sick or unpaid disability leave, but can be used C2c jerseys for parent or family care. Extensions of 60 days are available for educational or family care needs.
